Tryton trademark: request for nullity due to non-usage in China

The foundation has registered Tryton as trademark in China.
传奇有限公司 (Chuanqi Co., Ltd.) has request to revoke our trademark for the class 9.
In order to keep the trademark we need to provide proof within 2 months that the trademark has been used in China between May 27th 2023 and May 26th 2026 for the class 9 (computer and computer peripherals).

The Foundation has no commercial activity so we ask to the community if anyone can provide such proof (sale contract, invoice, report etc.)?

We have up to September 1st 2026 to collect the proofs and let our attorney prepare the answer.

Protecting the Tryton trademark in major countries is part of the role of the Foundation to protect the project.

Due to the small timeframe available the Foundation should maybe try to contact these parties:

Documented official installer download and use by a Shanghai-timezone user

In March 2024, Tryton forum user @jamespatriot

  • stated that they downloaded the Windows 64-bit installation file from the official “Get Tryton” page;
  • successfully installed it;
  • attempted to start the TRYTON client;
  • supplied installation and error screenshots;
  • received support and downloaded an earlier working version.

The user’s public forum profile specifies Asia/Shanghai as their timezone. This strongly suggests mainland-China use, although the Foundation should confirm the person’s location through its registration records. The March 2024 installation thread and screenshots fall squarely inside the evidentiary period.

Detailed Chinese installation record from July 2024

A Chinese 51CTO article dated 30 July 2024 documents:

  • installation of the TRYTON desktop client using pip install tryton;
  • launching the client;
  • connecting it to a server;
  • screenshots of the client and login;
  • installation of official TRYTON ERP modules;
  • links to the official TRYTON source and download infrastructure.

The complete Chinese TRYTON installation article is direct evidence that someone installed and ran the branded software in China during the period. However, it is marked as republished content, so identifying the original author and obtaining a statement or original screenshots would make it much stronger.

An identifiable Chinese TRYTON/GNU Health developer

Feng Shu, GitHub user and on forum: @tumashu , publicly lists:

During the relevant period, he maintained Chinese GNU Health translations and, in February 2024, reported modifying the GNU Health client’s TRYTON translation/text-domain configuration. His February 2024 technical report shows active use of TRYTON-derived client software.

Mainland Chinese TRYTON user community

The Odoo Chinese community hosts a dedicated TRYTON discussion section and advertises QQ group 971628300 for people “following, learning and using Tryton.” Chinese TRYTON community page.

The existing posts appear older, so they are not evidence for the critical period by themselves. However, this is likely the quickest route to locating Chinese companies or individuals with recent deployments and commercial documents.

To clarify, all I want is to collaborate with the community. It was never my intention to create more work for another maintainer. I will contact those entities myself; I just hadn’t done so before because I don’t have the authority of the Foundation or the exact details needed to make a request regarding the trademark.

We, Zacarias from Angola and Korbinian actually develop Tryton modules for shelf displays using MQTT services set up for Tryton. In this project, the chinese company https://www.minew.com delivers the displays and a gateway and we have a collaboration with them. As we bought test displays and gateways, we’d have kind of invoice. We also signed an NDA with them to protect their know how as we got access to certain deeper infos of their products so we are able to control their system directly out of Tryton (using the Tryton attached MQTT gateway service).

Is it for the China market ?
We need documents to show that Tryton or projects using Tryton are sold on the China market.

No luck with any of them. Only Tony replied, on August 19. Although they aren’t involved in any related commercial activities, they offered to reach out to other Chinese open-source ERP communities and spread the word.

I would try to contact your chamber of commerce or even the Belgian embassy in Peking. Austrian embassy maintains a list of “suspicious” chinese companies Liste verdächtiger chinesischer Firmen - WKO and this list came up when searching for 传奇有限公司 (Chuanqi Co., Ltd.) though I didn’t directly find the name on that list.

I could not find the company in the list. I think the search engine is broken.

Otherwise we will follow our attorney advise base on the fact that we could not collect any document.

This will be evaluated by the local attorney.
